Golden Dawn leader, MPs among 72 to stand trial

Greek judges are sending 72 members of neo-Nazi party Golden Dawn including its leaders to trial for crimes including murder, a judicial source said on Wednesday.

Seventy-two people, including party leader Nikos Michaloliakos and all of Golden Dawn’s lawmakers in the previous parliament will be tried, the source said.

The move capped a 15-month investigation launched after a Golden Dawn supporter fatally stabbed a Greek rapper in September 2013.

The aggressive anti-immigration party was later linked to the murder of a Pakistani immigrant and beatings of political opponents.

The defendants face sentences of up to 20 years in prison.

The trial date has yet to be set.

Once a fringe movement, Golden Dawn rose to prominence in the depths of Greece’s recession, capitalizing on popular anger towards the established political class.

Rejecting the accusations as political propaganda, the group held on to its support base in last month’s general election.

It finished third, won 17 seats in parliament and picked up over 388,000 votes, down about 38,000 from the previous ballot in 2012.

1ST LEAD Greece's far-right Golden Dawn lawmakers to stand trial By Christine Pirovolakis, dpa

Athens (dpa) – Lawmakers from Greeces far-right Golden Dawn party will stand trial on charges of operating a criminal organization, Greek state television said on Wednesday.

A council of judges voted for all 18 Golden Dawn lawmakers who held seats in the previous parliament – including its leader Nikos Michaloliakos – as well as 69 of its members to stand trial.

If found guilty the Golden Dawn lawmakers, including seven who are behind bars and another three under house arrest, could face 20 years imprisonment. The trial is expected to be held at the end of March or the beginning of April, local media reported.

Golden Dawn said it in statement that it had no knowledge of the judges decision and denied any wrongdoing.

The Greek government launched a widespread crackdown on the party after the murder of musician Pavlos Fyssas, 34, known as Killah P, last year. Fyssas was stabbed to death in Athens.

A Golden Dawn supporter was charged with voluntary manslaughter in the killing, but the partys leadership has denied any connection.

Investigators have linked the party to the murder of a Pakistani immigrant as well as the beating of a Greek female lawmaker from the Communist Party of Greece.

Despite the arrests, Golden Dawn, whose emblem resembles the Nazi swastika and whose members express admiration for Adolf Hitler, has maintained its popularity, coming third in parliamentary elections last month.

Thirteen of the 18 lawmakers standing trial have been re-elected in the Janaury 25 election and were expected to be sworn in on Thursday when the new Greek parliament holds its opening session.

Golden Dawn says the arrests are part of a political conspiracy to break up the party.

Islamisation Has Given Birth To European Pegida
Pegida is showing that it may go multi-national in Europe. Could it be that it will incorporate UKIP,BNP,Svoboda,Jobbik,French National Front, and Golden Dawn? That would be a game changer.

Under the 'fair use' rule of copyright law, an author may make limited use of another author's work without asking permission. Fair use is based on the belief that the public is entitled to freely use portions of copyrighted materials for purposes of commentary and criticism. The fair use privilege is perhaps the most significant limitation on a copyright owner's exclusive rights.

Fair use as described at 17 U.S.C. Section 107:

"Notwithstanding the provisions of section 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phono-records or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:

  • (2) the nature of the copyrighted work,
  • (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole, and
  • (4) the effect of the use upon the potential market for or value of the copyrighted work."
