Southern Poverty Law Center (SPLC) – 2ndvote

In 2012, a gunman attempted to gain access to the Washington, DC headquarters of the Family Research Council (FRC) and wounded an employee. The suspect would later tell FBI investigators he had planned to kill as many as possible and smear Chick-fil-A sandwiches on their faces as a political statement. He also claimed he had targeted FRC because the organization was listed by the Southern Poverty Law Center (SPLC) as a hate group.

SPLC uses the hate group tag to target its political enemies. In short, the term is a rhetorical weapon to be used against those who disagree with SPLCs ideology. In addition to FRC, SPLC has identified Alliance Defending Freedom, American Family Association, Liberty Counsel, organizations opposing illegal immigration, and many other groups as hate groups merely because of their traditional values, conservative principles, or Judeo-Christian beliefs.

WHO IS SPLC? The Southern Poverty Law Center (SPLC) was founded by Morris Dees in 1971 as an admirable group combatting racial prejudice, but over the years it has shifted focus, and now applies the hate label to groups with politics that are different from their deep-pocketed liberal donors.

This super-wealthy public-interest law firm headquartered in Montgomery, Ala., which is the wellspring and dominant think tank for outrageously defamatory leftwing attacks on individuals and organizations that embrace a different political point of view.

“Sometimes the press will describe us as monitoring hate groups, I want to say plainly that our aim in life is to destroy these groups, completely destroy them,” Potok declared at an event in Michigan in 2007.

In yet another 2008 speech, Potok explained the SPLC criteria for a “hate group.” The spokesman said, “Our criteria for a ‘hate group,’ first of all, have nothing to do with criminality, or violence, or any kind of guess we’re making about ‘this group could be dangerous.’ It’s strictly ideological” (emphasis added).

General Hate | Southern Poverty Law Center

These groups espouse a variety of rather unique hateful doctrines and beliefs that are not easily categorized. This list includes a Jewish group that is rabidly anti-Arab, a Christian group that is anti-Catholic and a polygamous Mormon breakaway sect that is racist. Many of the groups are vendors that sell a miscellany of hate materials from several different sectors of the white supremacist movement.

Is SPLC a Left-Wing Smear Group That Encourages Violent …

CLAIM

The Southern Poverty Law Center is a “left-wing smear group” that incites hatred and violence against conservatives.

In the wake of the shootings of U.S. House Minority WhipSteve Scalise (R-Louisiana) and threeother people at a GOP charity baseballpractice sessionin Alexandria, Virginia on 14 June 2017, partisan news and opinion outlets cited social media postings by the perpetrator, James T. Hodgkinson, to make the case that he was incited to violence by the (in their words) left-wing smear group the Southern Poverty Law Center (SPLC).

SPLCis a nonprofit organization headquartered in Montgomery, Alabamadedicatedto monitoring the activities of domestic hate groups and other extremists in the United States. SPLC publishes investigative reports, conductslaw enforcement training sessions, and provides expert analysis on hate groupactivities to the media and public. A key feature of their web site is a Hate Map spotlighting more than 900 groups that evincebeliefs or practices that attack or malign an entire class of people, typically for their immutable characteristics.

On the day of the Alexandria shootings, WorldNetDaily ran an article reporting that James Hodgkinson likedSPLC on Facebook (a fact confirmed by multiple sources prior to Facebooks deletion of Hodgkinsons page). The article furtherstated that SPLC had been linked to a domestic terror attack against a conservative Christian group called the Family Research Council (FRC) five years earlier:

SPLCs past targeting of FRC was cited in court as the impetus for an attack on the Christian organizations Washington, D.C., headquarters.

The legal team at Liberty Counsel, criticizing SPLC for falsely and recklessly labeling Christian ministries as hate groups, noted SPLC is responsible for the first conviction of a man who intended to commit mass murder targeted against a policy organization in Washington, D.C.

On August 15, 2012, Floyd Corkins went to the Family Research Council with a gun and a bag filled with ammunition and Chick-fil-A sandwiches. His stated purpose was to kill as many employees of the Family Research Council as possible and then to smear Chick-fil-A sandwiches in their faces (because the founder of the food chain said he believed in marriage as a man and a woman). Fortunately, Mr. Corkins was stopped by the security guard, who was shot in the process. Corkins is now serving time in prison. Mr. Corkins admitted to the court that he learned of the Family Research Council by reading the SPLCs hate map.

Similarly, theWashington Examiner ran an article stating that domestic terrorists Hodgkinson and Floyd Corkins were linked by their support of SPLC:

The shooter blamed for Wednesdays bloody attack on a Republican congressional baseball team shared a tie with the 2012 gunman who attacked the conservative Family Research Council in Washington.

Both were fans of the Southern Poverty Law Center.

And yet another right-leaning web site, Breitbart,claimedthat in addition to labelingthe Family Research Council a hate group, SPLC repeatedly implied that Rep. Steve Scalise, one of the peopleshot by James Hodgkinson in Alexandria, Virginia, is associated with white supremacists.

However, the implication that the Southern Poverty Law Center inspired or encouraged these acts of violence has no discernible basisin fact. Far from being an instigator, SPLC has consistently condemned the use of violence against any groups or persons for any reason, a stancereaffirmed in a public statement on the Alexandria attack by the organizations president, Richard Cohen:

The attack on members of Congress and their staffs today was a sickening and cowardly act of terror that must be condemned by everyone across the political spectrum. Any violent attack on our political leadership is an attack on our democracy.

Were aware that the SPLC was among hundreds of groups that the man identified as the shooter liked on Facebook. I want to be as clear as I can possibly be: The SPLC condemns all forms of violence. We have worked for decades to combat domestic terrorism and violence based on hate.

Our hearts are with those who were injured today and the families of all who have been affected by this deplorable act. We hope and pray for their full recovery.

A like on Facebook,moreover, does not a link to violencemake. We can conclude, based on his Facebook page,that James Hodgkinson knewof the Southern Poverty Law Centerand presumably approved of the workthey do, but beyond that there is no evidence to suggest he actively engaged with SPLC,or even read its published materials. Nor, despite Breitbarts implication of a connection between Hodgkinsons shooting rampage and comments SPLC previously made about Rep. Steve Scalise, is there any evidence to support a link.

In 2014, SPLC citeda report that Scalise gave a speech in 2002 to a group called European-American Unity and Rights Organization (EURO), an outspoken white nationalist organizationfounded by former Ku Klux Klan leader David Duke. The same article cited a 1999 Roll Callinterview in which Scalise appeared to compare himself to Duke:

Another potential candidate, state Rep. Steve Scalise (R), said he embraces many of the same conservative views as Duke, but is far more viable. The novelty of David Duke has worn off, said Scalise. The voters in this district are smart enough to realize that they need to get behind someone who not only believes in the issues they care about, but also can get elected. Duke has proven that he cant get elected, and thats the first and most important thing.

However, we have no way of knowing whether Hodgkinson even read the SPLCs report on Scalise, much less that it figured intoHodgkinsons motives for the shooting rampage, which, based on the evidence available thus far, does not seem to have beentargeted at Scalise personally.

Southern Poverty Law Center president Richard Cohen responded to our request for comment with this statement:

The Southern Poverty Law Center has consistently stood against violence in all its forms. Still, its not surprising that detractors would try to use the fact that our Facebook page was among the more than 600 thatJames T. Hodgkinsonliked as a way to link us to his cowardly attack on Republican lawmakers.

They would like the public to think that speaking out forcefully against bigotry is somehow equivalent to speaking in favor of it. The two are obviously not the same. Speaking out against bigotry helps to build an inclusive society, one in which everyone is entitled to equal dignity. Bigotry denies the equal dignity of all people. History tells us which is the more dangerous course.

General Hate | Southern Poverty Law Center

These groups espouse a variety of rather unique hateful doctrines and beliefs that are not easily categorized. This list includes a Jewish group that is rabidly anti-Arab, a Christian group that is anti-Catholic and a polygamous Mormon breakaway sect that is racist. Many of the groups are vendors that sell a miscellany of hate materials from several different sectors of the white supremacist movement.

Is SPLC a Left-Wing Smear Group That Encourages Violent …

CLAIM The Southern Poverty Law Center is a “left-wing smear group” that incites hatred and violence against conservatives. In the wake of the shootings of U.S. House Minority WhipSteve Scalise (R-Louisiana) and threeother people at a GOP charity baseballpractice sessionin Alexandria, Virginia on 14 June 2017, partisan news and opinion outlets cited social media postings by the perpetrator, James T. Hodgkinson, to make the case that he was incited to violence by the (in their words) left-wing smear group the Southern Poverty Law Center (SPLC). SPLCis a nonprofit organization headquartered in Montgomery, Alabamadedicatedto monitoring the activities of domestic hate groups and other extremists in the United States. SPLC publishes investigative reports, conductslaw enforcement training sessions, and provides expert analysis on hate groupactivities to the media and public. A key feature of their web site is a Hate Map spotlighting more than 900 groups that evincebeliefs or practices that attack or malign an entire class of people, typically for their immutable characteristics. On the day of the Alexandria shootings, WorldNetDaily ran an article reporting that James Hodgkinson likedSPLC on Facebook (a fact confirmed by multiple sources prior to Facebooks deletion of Hodgkinsons page). The article furtherstated that SPLC had been linked to a domestic terror attack against a conservative Christian group called the Family Research Council (FRC) five years earlier: SPLCs past targeting of FRC was cited in court as the impetus for an attack on the Christian organizations Washington, D.C., headquarters. The legal team at Liberty Counsel, criticizing SPLC for falsely and recklessly labeling Christian ministries as hate groups, noted SPLC is responsible for the first conviction of a man who intended to commit mass murder targeted against a policy organization in Washington, D.C. On August 15, 2012, Floyd Corkins went to the Family Research Council with a gun and a bag filled with ammunition and Chick-fil-A sandwiches. His stated purpose was to kill as many employees of the Family Research Council as possible and then to smear Chick-fil-A sandwiches in their faces (because the founder of the food chain said he believed in marriage as a man and a woman). Fortunately, Mr. Corkins was stopped by the security guard, who was shot in the process. Corkins is now serving time in prison. Mr. Corkins admitted to the court that he learned of the Family Research Council by reading the SPLCs hate map. Similarly, theWashington Examiner ran an article stating that domestic terrorists Hodgkinson and Floyd Corkins were linked by their support of SPLC: The shooter blamed for Wednesdays bloody attack on a Republican congressional baseball team shared a tie with the 2012 gunman who attacked the conservative Family Research Council in Washington. Both were fans of the Southern Poverty Law Center. And yet another right-leaning web site, Breitbart,claimedthat in addition to labelingthe Family Research Council a hate group, SPLC repeatedly implied that Rep. Steve Scalise, one of the peopleshot by James Hodgkinson in Alexandria, Virginia, is associated with white supremacists. However, the implication that the Southern Poverty Law Center inspired or encouraged these acts of violence has no discernible basisin fact. Far from being an instigator, SPLC has consistently condemned the use of violence against any groups or persons for any reason, a stancereaffirmed in a public statement on the Alexandria attack by the organizations president, Richard Cohen: The attack on members of Congress and their staffs today was a sickening and cowardly act of terror that must be condemned by everyone across the political spectrum. Any violent attack on our political leadership is an attack on our democracy. Were aware that the SPLC was among hundreds of groups that the man identified as the shooter liked on Facebook. I want to be as clear as I can possibly be: The SPLC condemns all forms of violence. We have worked for decades to combat domestic terrorism and violence based on hate. Our hearts are with those who were injured today and the families of all who have been affected by this deplorable act. We hope and pray for their full recovery. A like on Facebook,moreover, does not a link to violencemake. We can conclude, based on his Facebook page,that James Hodgkinson knewof the Southern Poverty Law Centerand presumably approved of the workthey do, but beyond that there is no evidence to suggest he actively engaged with SPLC,or even read its published materials. Nor, despite Breitbarts implication of a connection between Hodgkinsons shooting rampage and comments SPLC previously made about Rep. Steve Scalise, is there any evidence to support a link. In 2014, SPLC citeda report that Scalise gave a speech in 2002 to a group called European-American Unity and Rights Organization (EURO), an outspoken white nationalist organizationfounded by former Ku Klux Klan leader David Duke. The same article cited a 1999 Roll Callinterview in which Scalise appeared to compare himself to Duke: Another potential candidate, state Rep. Steve Scalise (R), said he embraces many of the same conservative views as Duke, but is far more viable. The novelty of David Duke has worn off, said Scalise. The voters in this district are smart enough to realize that they need to get behind someone who not only believes in the issues they care about, but also can get elected. Duke has proven that he cant get elected, and thats the first and most important thing. However, we have no way of knowing whether Hodgkinson even read the SPLCs report on Scalise, much less that it figured intoHodgkinsons motives for the shooting rampage, which, based on the evidence available thus far, does not seem to have beentargeted at Scalise personally. Southern Poverty Law Center president Richard Cohen responded to our request for comment with this statement: The Southern Poverty Law Center has consistently stood against violence in all its forms. Still, its not surprising that detractors would try to use the fact that our Facebook page was among the more than 600 thatJames T. Hodgkinsonliked as a way to link us to his cowardly attack on Republican lawmakers. They would like the public to think that speaking out forcefully against bigotry is somehow equivalent to speaking in favor of it. The two are obviously not the same. Speaking out against bigotry helps to build an inclusive society, one in which everyone is entitled to equal dignity. Bigotry denies the equal dignity of all people. The Hill: Bannon Presses Trump to Hire Experienced Legal Team

Special counsel Robert Mueller’s investigation into possible Russian collusion with the 2016 Trump campaign has White House aides worried, despite the assurances of President Trump’s lawyer Ty Cobb that Mueller is handling the investigation “fairly.” Some sources close to the president have reportedly expressed doubts about Cobb’s competency to lead the White House’s defense. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."

Under the 'fair use' rule of copyright law, an author may make limited use of another author's work without asking permission. Fair use is based on the belief that the public is entitled to freely use portions of copyrighted materials for purposes of commentary and criticism. The fair use privilege is perhaps the most significant limitation on a copyright owner's exclusive rights.

Fair use as described at 17 U.S.C. Section 107:

"Notwithstanding the provisions of section 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phono-records or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:

  • (1) the purpose and character of the use, including whether such use is of a commercial nature or is for or nonprofit educational purposes,
  • (2) the nature of the copyrighted work,
  • (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole, and
  • (4) the effect of the use upon the potential market for or value of the copyrighted work."
