Harvard Law Professor Emeritus Alan Dershowitz said Tuesday on “Tucker Carlson Tonight” that FBI Agent Peter Strzok’s claim that his 2016 reference to a “leak strategy” meant he wanted to prevent bureau leaks “doesn’t pass the giggle test.”

Dershowitz said he has been bothered by intentional leaks from within the FBI since the tenure of controversial Director John Edgar Hoover, who served from 1924 to 1972.

“[Hoover] notoriously lived by leaks,” Dershowitz said. “He threatened political enemies.”

Dershowitz said there should be an investigation into the current alleged leaks and into the newfound email between Strzok and his lover, former FBI attorney Lisa Page, that referenced such a “leak strategy.”

Alan Dershowitz Has Bad News For Anyone Thinking President …

Liberal Harvard professor emeritus Alan Dershowitz on Wednesday took the wind out of the sails of those who hope Michael Cohens Tuesday plea deal with prosecutors will lead to President Trumps impeachment or criminal implication.

He is more correct than his critics are, said Dershowitz on Wednesdays edition of Fox News Special Report With Bret Baier. Its complicated. The law is clear that the president may contribute to his own campaign, so if the president had paid $280,000 to these two women, even if he had done so in order to help his campaign, that would be no problem, it would be legal. If Cohen himself made the contribution that would be unlawful because he has a limit of $5200.

Dershowitz then described a catch-22 prosecutors are in.

If he believes Cohen that the president directed him to do it, then thats not a crime at all. If he doesnt believe Cohen, then Cohen has committed a crime and not the president and the legal pundits have been saying if Cohen admits to a crime, that makes Trump an unindicted coconspirator just wrong as a matter of basic criminal law. You dont become an unindicted coconspirator if your action is lawful even though the action of the other person is unlawful.

Its not even a close question, that is so over-the-top, Dershowitz said after Baier played a clip of Trump being accused of high crime and misdemeanor. It is not a crime to contribute to your own campaign. If he had written a letter to these two women saying youre going to hurt me in my campaign, Im going to pay you $150,000 to help me get elected president and you have to keep it quiet, its hush money. No crime.

I challenge any of those who say its a crime to find me anything in the criminal law that would make it a crime for a president personally or candidate personally to pay in order to save his own election, said Dershowitz. Its just not against the law. It may be a political sin, even if it determined the outcome of the election but the rule of law requires that when you say something is a crime, show me the statute.

Show me the statute, he continued. There is no statute that would make that a crime. It might be a misdemeanor for the campaign to fail to report that payment but it would be on the campaign not on the candidate. Thats not even a close question. To talk about this as a high crime and misdemeanor, its absurd. Thats not the kind of thing the framers had in mind.

The View Grills Alan Dershowitz on Constant Trump Defense

The blowback Alan Dershowitz has been receiving on Marthas Vineyard for his perceived support of President Trump might be overblown. But it was very real on The View Tuesday morning.

From the start of his multi-segment interview, Dershowitz was over-the-moon to be seated at the table with Whoopi Goldberg, Joy Behar, and the rest of the gang. I am such a big fan of every single one of you. Im so thrilled to be on this show. he exclaimed. Im really ready to mix it up with you guys. And mix it up they did.

They began with Trumps nomination of Judge Brett Kavanaugh to replace Supreme Court Justice Anthony Kennedy. As a liberal Democrat, Dershowitz said he never would have chosen Kavanaugh himself, but also called him the least worst choice from the Democratic perspective. He also threw a bone to the Left by saying Republicans stole President Obamas Supreme Court pick, Merrick Garland. Absolute theft. Unconstitutional, he said, adding, The Constitution says advise and consent, not delay and postpone.

And yet, even after the way Senate Majority Leader Mitch McConnell (R-KY) and the GOP acted in 2016, Dershowitz said Democrats should not oppose Kavanaugh on principle. Why shouldn’t Democrats play hard ball? Joy Behar asked him. Why should we always be the snowflakes?

As for Kavanaughs past assertion that a president should not be subject to criminal prosecution, Dershowitz admitted that the new justice might have to recuse himself should the Russia investigation make it to the Supreme Court.

It was the subject of impeachmentalso the theme of Dershowitzs new book, The Case Against Impeaching Trumpthat drove most of the hosts argumentative questions. Pressed by fellow lawyer Sunny Hostin on whether Trump could be impeached for obstructing justice, Dershowitz said, I don’t believe a president can obstruct justice by merely exercising his authority to fire somebody.

When Meghan McCain said she was under the impression that he was a Trump supporter, Dershowitz shot back, Oh god no. Asked why he was being ostracized by his former friends on Marthas Vineyard, Dershowitz offered up a hypothetical.

If Hillary Clinton had been electedby the way, I would have be thrilled, I worked hard on her campaignand they were trying to lock her up, he said, I would have written the same book except it would have had a different name, The Case Against Impeaching Clinton. I would have said exactly the same thing, made the same arguments and the people on Marthas Vineyard would be hugging me and kissing me and all the liberals would love me. But because I’m making the case for a president they disapprove of, a civil liberties-neutral case, they don’t like me so much.

Dershowitz added, It makes you understand the difference between your real friends.

Later, after a break, Dershowitz confirmed that hes back in dialogue with people who weren’t originally talking to me, and seemed to express at least some small regret in making himself out to be a victim. This is a bigger issue than just him, he added.

You need to find a legal argument to impeach him and then well all like you more, Behar told him.

So far, theres no evidence hes committed an impeachable crime, Dershowitz said, despite the fact that no one on the Left is seriously pushing for impeachment before the Mueller investigation comes to its conclusion. If youre going to remove a president, you better comply with the letter of the Constitution. This shouldnt be political.

Heres the thing, Behar added. The guy is under investigation by the FBU for collusion, for obstruction, for violating the emoluments clause, there’s a list of things. And as you mentioned Mitch McConnell stole the last Supreme Court justice, which I think should be illegal, but it probably isnt. Why should we give the president who is under investigation the chance to affect the lives of millions of people with this next Supreme Court justice?

Because if you dont, every president will be put under investigation to prevent them from making Supreme Court nominations, Dershowitz replied. Later, he criticized the ACLU for refusing to protect Trumps civil liberties.

Im the only guy standing on this issue, Dershowitz said. Ive always defended people that no one else will defend.

Just as that defense didnt win him any friends on Marthas Vineyard, it also made him pretty unpopular on The View.

If he had written a letter to these two women saying youre going to hurt me in my campaign, Im going to pay you $150,000 to help me get elected president and you have to keep it quiet, its hush money. No crime. I challenge any of those who say its a crime to find me anything in the criminal law that would make it a crime for a president personally or candidate personally to pay in order to save his own election, said Dershowitz. Its just not against the law. It may be a political sin, even if it determined the outcome of the election but the rule of law requires that when you say something is a crime, show me the statute. Show me the statute, he continued. There is no statute that would make that a crime. It might be a misdemeanor for the campaign to fail to report that payment but it would be on the campaign not on the candidate. Thats not even a close question. The View Grills Alan Dershowitz on Constant Trump Defense

The blowback Alan Dershowitz has been receiving on Marthas Vineyard for his perceived support of President Trump might be overblown. But it was very real on The View Tuesday morning. From the start of his multi-segment interview, Dershowitz was over-the-moon to be seated at the table with Whoopi Goldberg, Joy Behar, and the rest of the gang. I am such a big fan of every single one of you. Im so thrilled to be on this show. he exclaimed. Im really ready to mix it up with you guys. And mix it up they did. They began with Trumps nomination of Judge Brett Kavanaugh to replace Supreme Court Justice Anthony Kennedy. As a liberal Democrat, Dershowitz said he never would have chosen Kavanaugh himself, but also called him the least worst choice from the Democratic perspective. He also threw a bone to the Left by saying Republicans stole President Obamas Supreme Court pick, Merrick Garland. Absolute theft. Unconstitutional, he said, adding, The Constitution says advise and consent, not delay and postpone. And yet, even after the way Senate Majority Leader Mitch McConnell (R-KY) and the GOP acted in 2016, Dershowitz said Democrats should not oppose Kavanaugh on principle. Why shouldn’t Democrats play hard ball? Joy Behar asked him. Why should we always be the snowflakes? As for Kavanaughs past assertion that a president should not be subject to criminal prosecution, Dershowitz admitted that the new justice might have to recuse himself should the Russia investigation make it to the Supreme Court. It was the subject of impeachmentalso the theme of Dershowitzs new book, The Case Against Impeaching Trumpthat drove most of the hosts argumentative questions. Pressed by fellow lawyer Sunny Hostin on whether Trump could be impeached for obstructing justice, Dershowitz said, I don’t believe a president can obstruct justice by merely exercising his authority to fire somebody. When Meghan McCain said she was under the impression that he was a Trump supporter, Dershowitz shot back, Oh god no. Asked why he was being ostracized by his former friends on Marthas Vineyard, Dershowitz offered up a hypothetical. If Hillary Clinton had been electedby the way, I would have be thrilled, I worked hard on her campaignand they were trying to lock her up, he said, I would have written the same book except it would have had a different name, The Case Against Impeaching Clinton. I would have said exactly the same thing, made the same arguments and the people on Marthas Vineyard would be hugging me and kissing me and all the liberals would love me. But because I’m making the case for a president they disapprove of, a civil liberties-neutral case, they don’t like me so much. Dershowitz added, It makes you understand the difference between your real friends. Later, after a break, Dershowitz confirmed that hes back in dialogue with people who weren’t originally talking to me, and seemed to express at least some small regret in making himself out to be a victim. This is a bigger issue than just him, he added. You need to find a legal argument to impeach him and then well all like you more, Behar told him. So far, theres no evidence hes committed an impeachable crime, Dershowitz said, despite the fact that no one on the Left is seriously pushing for impeachment before the Mueller investigation comes to its conclusion. The guy is under investigation by the FBU for collusion, for obstruction, for violating the emoluments clause, there’s a list of things. And as you mentioned Mitch McConnell stole the last Supreme Court justice, which I think should be illegal, but it probably isnt. Why should we give the president who is under investigation the chance to affect the lives of millions of people with this next Supreme Court justice? Because if you dont, every president will be put under investigation to prevent them from making Supreme Court nominations, Dershowitz replied. Later, he criticized the ACLU for refusing to protect Trumps civil liberties. Im the only guy standing on this issue, Dershowitz said. Ive always defended people that no one else will defend. Just as that defense didnt win him any friends on Marthas Vineyard, it also made him pretty unpopular on The View.
